These terms and conditions ("Terms") govern your use of the Windsor Deck & Fence website at windsordeckandfence.com and any services we provide to you as a customer. By using our website or engaging us to perform work, you agree to these Terms. Please read them carefully. If you have any questions, contact us before proceeding.
By accessing windsordeckandfence.com, submitting a contact form, calling us, or entering into a written contract with Windsor Deck & Fence, you confirm that you have read and agree to these Terms. If you do not agree, please do not use our website or engage our services.
These Terms apply to all visitors to windsordeckandfence.com and all customers who engage Windsor Deck & Fence for any service. Our written project contracts may include additional terms specific to your project. In the event of a conflict, the written project contract controls.
Windsor Deck & Fence provides deck and fence construction, installation, repair, and related outdoor structure services in Windsor, CA and surrounding Sonoma County communities. Services include, but are not limited to, custom deck design and build, composite and wood deck installation, deck repair and replacement, fence installation, pergola installation, covered patios, and related work.
All services are provided under a written contract that specifies the scope of work, materials, timeline, and price. We do not begin work without a signed agreement.
The information on windsordeckandfence.com is provided for general informational purposes only. Descriptions, images, and cost ranges on this website are illustrative and do not constitute a binding offer or commitment to perform any specific work at any specific price.
We provide written estimates at no charge. An estimate is a good-faith assessment of the cost for a described scope of work at the time it is issued. Estimates are based on the information available at the time of the site visit and are subject to change if the actual scope of work differs from what was discussed.
An estimate is not a binding contract. Work begins only after you have reviewed, approved, and signed a written project contract that specifies the final price and scope.
If conditions discovered during construction require changes to the agreed scope - such as unexpected rot, unstable soil, or concealed obstructions - we will notify you in writing before proceeding with any additional work. Change orders must be approved by you in writing before additional work is performed.
Any cost ranges published on this website are general reference points only. Actual project costs depend on site-specific conditions, material choices, project size, and current market pricing for labor and materials.
Project start dates are estimated at the time of contract signing and are subject to permit approval timelines, material availability, and weather conditions. We will communicate any schedule changes to you as soon as we become aware of them.
If you need to cancel or postpone a project after signing a contract, please notify us in writing as soon as possible. Cancellation terms, including any deposits already paid, are governed by your written project contract. If no cancellation terms are specified in the contract, reasonable notice of at least five business days is expected before the scheduled start date.
We reserve the right to reschedule work due to weather conditions that make outdoor construction unsafe or impractical. We will work with you to find the earliest available alternative start date.
Payment terms are specified in your written project contract. In general, we require a deposit at contract signing, with the remaining balance due upon project completion unless otherwise agreed in writing.
Final payment is due upon completion of all work described in the project contract and issuance of any required final inspection approvals. We accept payment by check, bank transfer, or other methods specified in your contract.
Late payments may be subject to a late fee as described in your contract. If payment is not received within the agreed timeframe, we reserve the right to file a mechanics lien against the property in accordance with California law.
Disputes about the quality of work do not suspend your payment obligation for undisputed portions of the contract. If you have a concern about completed work, contact us in writing so we can address it promptly.
For projects that require a building permit, Windsor Deck & Fence will apply for and obtain the required permits as part of the project scope, unless otherwise agreed in writing. Permit fees are the responsibility of the customer and are typically included in the project estimate.
You are responsible for obtaining any required homeowners association (HOA) approval before construction begins. If your project is subject to HOA review, work will not begin until you provide written confirmation that HOA approval has been granted.
All work performed by Windsor Deck & Fence is intended to comply with applicableCalifornia building codes and local ordinances at the time of construction. We are not responsible for code changes that occur after a project is completed.
Windsor Deck & Fence warrants that all work will be performed in a good and workmanlike manner and in accordance with the specifications in your written contract. Any warranty on workmanship is described in your project contract. Manufacturer warranties on materials such as composite decking boards, hardware, and fasteners are governed by the respective manufacturer's terms and are separate from our workmanship warranty.
Our warranty does not cover damage caused by: acts of nature including storms, flooding, or fire; improper use or maintenance by the property owner; damage caused by third parties; or normal wear consistent with the age and materials of the structure.
THE WEBSITE AT WINDSORDECKANDFENCE.COM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
To the maximum extent permitted by California law, Windsor Deck & Fence will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or from any services we provide, including but not limited to loss of income, loss of use, or damage to property beyond the scope of our work.
Our total liability to you for any claim arising from services we perform shall not exceed the amount you paid us for the specific project giving rise to the claim. Nothing in these Terms limits liability for personal injury caused by our negligence, or any liability that cannot be excluded under applicable law.

If we are unable to resolve a dispute informally, either party may pursue resolution through the California Contractors State License Board, small claims court for claims within its jurisdictional limits, or through binding arbitration under the rules of a mutually agreed arbitration provider.
Nothing in this section prevents either party from seeking emergency injunctive relief from a court to prevent immediate harm.
These Terms and any disputes arising from them are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms or from services provided by Windsor Deck & Fence shall be brought in the courts of Sonoma County, California.
We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date at the top. Your continued use of our website or services after a revision constitutes your acceptance of the updated Terms.
For active project contracts already signed, the Terms in effect at the time of signing govern unless both parties agree in writing to apply updated Terms.
